Calculation on common facilities compensation is until the VP date. whereby its the same as LAD claim (no.of days).
But when I collect key, the facilities is not ready to use.e.g. court,pool.club and etc. Only recently, the swimming pool just filled up, i think about 3 weeks ago.
Can we highlight to them?! any chances of getting more days to refund?! _________________ Katml |

From top management. Checked by end of this month.
They are calculating according to SPA agreement date.
They refer me to the third schedule of SPA, when I ask why is not the first day of partial downpayment made.

Be informed. LAD claims need to submitted in writing. Otherwise it will be ignored! Computer generated replies will be issued by developer.... |

Yes.
I received a letter on Dec 9, 2004 - responding my LAD claim sent on Oct 21, 2004.
What surprised me is the letter was dated October 29, 2004.

| That's one bad habit of developer! They either send their mail very late or back date it! Same applies to maintenance bills, etc... Keep the envelope where the mail in it was send. It has the evidence the date it was posted out! The date chopped on it... |

What is the content of the reply from dev on LAD?
Did they include the LAD for facilities? And did they send you the cheque as well?

Hi all,
I received the same letter too. I think they send the same letter to everyone who hand in the LAD claim letter.
They only specify "soonest possible" and no exact date promised. This is just trying to make us wait and thus not going to tribunal. But how long do we need to wait??
Anyone got any latest news? |

I've received a letter from developer regarding the LAD claim.
They proposed to pay 80% instead and on top of that, deduction of maintenance fees + sinking fund for 2 years.
eg:
a) 100% LAD claim is $6000
b) maintenance fees + sinking fund for 2 years is $3000
ie. net payable to you is $6000 - $3000 = $3000
They request you to sign the proposal IF you agreed with the condition.
My advise is not to agreed cos we are losing interest and is an opportunity for them to roll OUR $$$.
1) I would gain some interest if I dump in the 2 years maintenance fee + sinking fund to fixed deposit or bank account.
There is no response from the media about the write up. Perhaps my statement is not attractive. If anyone could help to draft another statement and send to media (ie. editor@thestar.com.my).
Please note forum is just to gather information and discussion. You need to ACTION individually, for instant...
a) have you open a file at Tribunal?!
b) did you call developer giving them a hard time and irritates them?
c) did you spread this dishonourable company to everyone?
Please dont just sit back and ask the same question discussed earlier.

I have received the same letter. After thinking it through I am not going to accept the offer. I am going to counter -propose that they pay me 90% of the LAD amount and payment to be paid in one lump sum if they want to settle. Other wise I will register my case with the tribunal and ask for 100%. I will give them 2 weeks.

Why must give them credit if we are entitle to get 100%??!!
And meaning?!,,,, you agreed with the 2 years maintenance fees paid on behalf??!!.....
So, you've not login your case in tribunal yet?!...
fyi, if you open a file at tribunal now, you still need to wait for 4-6 months for hearing.

Hi Katml,
I guess it depends on your luck. My friend and myself, signed the S&P on the same day but the no. of days delay in our LAD letter are different. For myself, it was based on the S&P date whereas for my friend is based on the 10% down payment.
I have checked with the tribunal and confirmed that the LAD claims will based on the full 10% downpayment.
How about yours ? |

Hi Max,
Are you sure the calculation is based on FULL 10% downpayment?!
I signed the S&P upon paying my partial 10% downpayment /booking fees and about a month later, I receive S&P. Hence, I've lose out a month claim on LAD.
Many of my friends consult, we can claim the LAD based on the partial downpayment/booking fees.
Like your incident, did you and your friend clarify with developer? I dont believe its LUCK. Its a standard method of calculation. _________________ Katml |

To those who want their 100% LAD and hasn't file LAD claim with the tribunal, do it ASAP.
You lose out everyday, don't wait anymore.
Even after you accept their offer, do you know when are you going to get your cheque?? |
